Vodafone loses India court battle

The high court in Mumbai has decided that Vodafone does need to pay the Indian government $2bn in tax for its purchase of Hutchison Essar

The Mumbai high court has ruled that that India’s tax authorities have the right to pursue Vodafone over its estimated $2 billion tax bill.
The court dismissed Vodafone’s petition that the tax authorities had no jurisdiction to tax Vodafone’s $11.2 billion purchase of a 67% stake in Indian mobile phone operator Hutchison Essar from Hong Kong-based Hutchison Telecommunications in 2007.
Justices DY Chandrachud and JP Devadhar explained that as income from the transaction was accrued in India then the transaction is taxable in India and the authorities have jurisdiction over this deal.
